Public Law 91-596, the OSH ACT of 1970, Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the discharge end of the Ultra High Molecular Weight Polyethylene Chemical Suction & Discharge hose, being used to pump hot (120-180 degrees Fahrenheit) 93-98% sulfuric acid from the #2 Sulfuric Acid Plant's Elementary Neutralization Unit, or sump, into two metal-reinforced 300-330 gallon capacity poly totes, at ~50 gallons per minute, was not sufficiently secured to prevent the hose-end from escaping the tote and spraying acid onto other employees working in the area. (a) On or about August 9-10, 2013, Hydrovac employees vacuuming Mississippi Phosphates Corporation's (MPC) #2 Sulfuric Acid Plant's Elementary Neutralization Unit, or sump, created an exposure to hot sulfuric acid (H2SO4) for themselves and other (MPC) workers in the area when they failed to properly secure the discharge-end of a 2 - 2.5 inch diameter pump hose which was being used to transfer the hot sulfuric acid from the #2 SAP sump into two 300-330 gallon poly totes.
