29 CFR 1910.95(i)(2)(ii): The employer did not ensure that hearing protectors are worn by any employee who is exposed to an 8-hour time-weighted average of 85 decibels or greater: (a) In the Plant 1 Hull Cutting/Grinding Area, on or about July 9, 2013, the use of hearing protectors was not enforced for the Cutter/Grinder who was exposed to noise at 322% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 93.4 dBA during the 490 minute sampling period, resulting in a noise hazard. (b) In the Plant 1 Deck Cutting/Grinding Area, on or about July 9, 2013, the use of hearing protectors was not enforced for the Cutter/Grinder who was exposed to noise at 293% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 93.5 dBA during the 429 minute sampling period, resulting in a noise hazard. (c) In the Plant 1 Woodshop, on or about July 9, 2013, the use of hearing protectors was not enforced for the Carpenter who was exposed to noise at 114% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 85.7 dBA during the 498 minute sampling period, resulting in a noise hazard.
