OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that in that employees were elevated working from wooden and plastic crates that were supported by a forklift, thus exposing employees to fall and struck-by hazards: a) Outside onion crate staging area across street - On or about, and at times prior to July 25, 2013, employees used a JCB 930, Rough Terrain forklift to elevate employees to attach corner bracing diagonally to the corners of the stacked crates. The forklift manufacture does not allow lifting personnel with this model, exposing an employee to struck-by and fall hazards up to about 16 feet. b) Outside onion waste truck near refueling area - On or about, and at times prior to July 25, 2013, employees who operated forklifts throughout the jobsite attached with rotators used an unapproved platform such as onion crates to elevate personnel onto the back of the onion waste truck, exposing an employee to struck-by and fall hazards up to about 8 feet. c) Continuous Bin Tilt (CBT) machines # 1 and # 2 - On or about, and at times prior to July 25, 2013, employees who operated forklifts throughout the jobsite attached with rotators elevated employees using an unapproved work platform (onion crate) onto the CBT machines to reset sensors, un-jam onion crates, exposed employees to struck-by and fall hazards up to about 10 feet. d) Portable Onion Hoppers throughout facility - On or about, and at times prior to July 25, 2013, employees who operated forklifts throughout the jobsite attached with rotators used an unapproved work platform to elevate personnel onto the onion hoppers to retrieve broken onion crates, thus exposing employees to struck-by and fall hazards up to about 10 feet.
