OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the material handling attachment point failed under loading which resulted in an employee being struck by a shackle. (a) Gas 008 and other sites: On or about July 3, 2013 and at times prior, the employer did not use a substantial and engineered pulling method to pull underground pipe. The employer created and utilized an attachment point of an undetermined load-handling capacity which failed while pulling pipe. The rigging recoiled and struck an employee in the upper body causing fatal injuries.
