OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard as a result of the failure of the parking brake, allowing a rough terrain forklift to roll down an incline: a.) CIA Headquarters Compound: On or about 06/19/13, the parking brake of the JCB Rough Terrain Forklift, Model No. 506C Serial Number 1290418, failed, causing the forklift to roll down an incline and strike an employee, causing his death. The forklift parking brake was not inspected according to the manufacturer's instructions prior to being operated.
