Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employeesexposed to struck-by hazards: On or about June 11, 2013 the employer failed to develop and implement procedures for the movement of railcars exposing employees to the hazard of being struck-by and/or crushed by uncontrolled rolling stock and/or runaway railcars. Among other methods, some feasible and acceptable abatement methods to correct this hazard may include, but are not limited to the following: 1. Develop, implement and enforce procedures that ensure the complete control the railcar string during the coal loading operations, to include equipment designed for the movement of railcars. 2. Ensure that employees are trained on the operation of and limitations of the capabilities of railcar handbrakes as indicated in Paragraphs 7.5 and 7.6 of General Code of Operating Rules for railroads dated April 7, 2010 and paragraph M-17.e of the WATCO Transportation Inc System Special Instructions dated January 15, 2012.
