OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and caught-between hazards from defective safety related equipment on a delivery truck: a) Lowe's Home Centers, Inc. / Store #1130 / New Castle, PA: On or about May 28, 2013 , delivery truck (24-foot Chevy C6500 Lowe's number 14080 and VIN # GBJC1C84F902108) had a defective parking brake in that the parking brake was not functioning properly. The vehicle would not hold in place when the parking brake was tested. The condition exposed personnel to struck-by and caught-between hazards from the delivery truck. b) Lowe's Home Centers, Inc. / Store #1130 / New Castle, PA: On or about May 28, 2013 , delivery truck (24-foot Chevy C6500 Lowe's number 14080 and VIN # GBJC1C84F902108) was equipped with a back-up alarm that was not functioning. The condition exposed personnel to struck-by and caught-between hazards from the delivery truck.
