OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about May 2, 2013, in the warehouse area, employees were standing on the forks of a forklift to gain access to high shelving units to place and extract product from shelves, exposing employees to a 10 feet fall hazard.
