29 CFR 1910.146(d)(5)(ii): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not evaluate permit space conditions when entry operations were conducted by testing or monitoring the permit space as necessary to determine if acceptable entry conditions are being maintained during the course of entry operations: (a) The employer failed to ensure testing or monitoring were conducted as necessary during permit required confined space entry operations to ensure entry conditions were being maintained during the course of entry operations in confined space locations such as: (1) The scrubber tower: Employees entering the scrubber tower were potentially exposed to carbon monoxide, sulfur dioxide, oxygen deficiency, and fall hazards. Abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
