OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential hazards created by the operation of a Class IV laser. On or about March 21, 2013 and times prior thereto, the employer had in operation at its facility in Paragould, Arkansas an Amada Lasmac LC 2415 alpha III for cutting material. The laser is labeled as a Class IV laser product and the facility did not have a designated Laser Safety Officer. Direct or diffuse contact with a class IV laser beam exposes employees to serious skin burns and irreversible eye injuries.
