Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by vehicles while operating and working around loaders that were not properly marked on public roadways during the hours of darkness: (a)Berkeley and Jefferson County Routes: Employees were exposed to the hazard of being struck by moving vehicles while working on or around improperly marked rear loaders on public roadways. Mack rear loader #605 did not have retroreflective sheeting applied to the back of the loader above and below the hopper and on the upper right and upper left contours of the header board, as determined on March 13, 2013. (b)Berkeley and Jefferson County Routes: Employees were exposed to the hazard of being struck by moving vehicles while working on or around improperly marked rear loaders on public roadways. Mack rear loader #619 had damaged retroreflective sheeting below the hopper on the back of the loader, as determined on March 13, 2013. (c)Berkeley and Jefferson County Routes: Employees were exposed to the hazard of being struck by moving vehicles while working on or around improperly marked rear loaders on public roadways. Mack rear loader #603 did not have retroreflective sheeting above the hopper on the back of the loader and on the upper right and upper left contours of the header board, as determined on March 13, 2013.
