Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by moving vehicles and equipment. On or about 4 February 2013, and at times prior thereto, employees were rolling up 3-inch poly pipe by spooling it onto a trailer mounted reel that was being pulled by a Ford F-350 truck along the side of a county road. Instance 1: An employee was sitting on the tongue of the trailer while a second employee was sitting on the back edge of the flatbed truck that was pulling the trailer approximately 10 mph, exposing the employees to the hazard of being struck by the moving vehicles. Instance 2: Three employees engaged in oil rig water services were working along CR 294 without the use of High Visibility clothing, exposing the employees to the hazard of being struck by moving vehicles. While rolling up the 3-inch poly pipe, the employees were helping guide the pipe onto the trailer-mounted reel, which required them to be on and alongside the road during the activity. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure employees ride inside the cab of the truck while the vehicle is moving and to wear high visibility clothing when required to work on or near the roadway.
