Text For Citation: 01 Item/Group: 001 Hazard:
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. In that employees were exposed to the hazard of being struck by vehicular traffic when working on or near 3rd Street in Talmage, NE, South of the facility located at 122 N. Main Street, Talmage, NE 68448. (a) On or around January 29, 2013 and at times prior to, Employees were instructed by the employer to stand on the South of the facility across 3rd Street for the purposes of directing grain trucks under the spouts as they were being loaded; and/or (b) On or about January 29, 2013 an employee of the company was struck by a grain truck that was backing down 3rd Street as he was positioning a second truck under the leg to be filled. This exposed employees to being struck by backing vehicular traffic. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to: 1. Develop and implement a traffic pattern when loading and unloading trucks which would provide for the safety of pedestrians or workers in the areas where trucks are backing; 2. Policies and procedures to address backing and struck by traffic hazards, including, use of high visibility garments, use of a spotter when trucks back, and or requiring trucks not to back if at all possible.
