Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards resulting from failure to protect foot activation pedal of "Niagara" press brake: a) Central Shop Area - the foot activation pedal of the "Niagra" press brake (model IB-60-8-10, serial #42941) was unguarded. This condition could result in the inadvertent activation of the press brake, and could result in crushed fingers or hands. Observed 8/17/87. NOTE: Among other methods, two feasible and acceptable abatement methods are: 1) Removal of foot pedal when the machine is not in use; or 2) Locking the foot pedal, if the pedal has not been removed, to prevent operation when the machine is not in use.
