OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught in and crushed by hazards: On or about December 26, 2012, the employer did not maintain a safe zone around the New Way 11 yard Viper rear load trash packer when the tailgate is activated exposing employees to caught-between and crushed-by hazards.
