OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while unloading vehicles from a car carrier. a) Worksite, 510 Grumman Rd. West, Bethpage NY - A vehicle transport operator fell approximately 8ft to the ground below while unloading a vehicle from a car carrier. The employee was not protected from falling; on or about 11/21/12. b) Worksite, 510 Grumman Rd. West, Bethpage NY - A vehicle transport operator was exposed to falling approximately 5-7ft to the ground below while unloading vehicles from the trailer. The employee was not protected from falling while standing on the edge of trailer; on or about 12/4/12. c) Worksite, 510 Grumman Rd. West, Bethpage NY - A vehicle transport operator was exposed to falling approximately 7ft to the ground below while unloading vehicles from the trailer. The employee was not protected from falling while standing on the edge of the trailer; on or about 4/2/13. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
