OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer did not develop and implement a written procedure for the assembly and disassembly of the SAFESPAN scaffold system with specific instructions for safe work practices which include, but should not be limited to, establishing a safe wind condition limitation, limiting the number of employees working in and around disconnected panel section(s) and ensuring that the employee(s) removing the panel sections is/are not standing on the panel section being disconnected from the support system.
