OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to struck-by / caught-between hazards from felling of "hanger" tree(s) which was leaning on and/or lodged in an adjacent tree. a) The employer attempted to fell a "hanger" tree in the back yard of a single-family residence though a series of base section cuts from the trunk suspended in rope rigging lashed to other nearby trees. This method caused the trunk, in excess of 50' length, to drop to the ground at a more vertical angle with each sequential cut; all the while with person(s) in the danger area exposed to uncontrolled falling / swinging of the trunk. Condition(s) were noted on or about 11/8/2012.
