Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee in that employees were exposed to struck-by traffic hazards: a) On or about 11/06/12 at 148/152 Klinesville Road, Flemington, NJ 08822. Employees were exposed to being struck by vehicular traffic when offloading excavation equipment on an active two lane road. ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD, AMONG OTHER MEANS, WOULD BE FOR THE COMPANY TO COMPLY WITH THE FEDERAL HIGHWAY ADMINISTRATION MANUEL ON UNIFORM TRAFFIC CONTROL DEVICES (MUTCD), 2009 EDITION: (1) Section 6E.02 (Highway Visibility Safety Apparel) which requires that Flaggers shall wear high-visibility safety apparel that meets the performance Class 2 or 3 requirements of the ANSI/ISEA 107-2004. (2) Section 6E.03 (Hand Signaling Devices) which states that: The STOP/SLOW paddles shall be primary and preferred hand signaling device. Use of flags should be limited to emergency situations. (3) Section 6E.07 (Flagger Procedures) which addresses the methods that shall be used by flaggers to alert oncoming traffic and Figure 6H-10 which is the typical application for Lane Closure on a Two-Lane Road Using Flaggers. Required signage to include One Lane Road and Flagger Sign.
