OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees who were exposed to struck-by hazards. On or about October 19, 2012, an employee operating a Mustang skid steer loader, model 2054, with the bucket in the raised position was exposed to the hazard of struck-by. The interlocking safety device on the seat had been by-passed, the lap safety bar was in the raised position, and the locking pins on the lift arms were not engaged.
