Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees, in that: foot pedal mechanism(s) on machinery were not protected or were inadequately protected to prevent unintended operations from falling or moving objects or by accidental stepping onto the pedals: a) The foot pedal on the Cyril Bath mechanical press brake, model 120-8, serial number 5851, located in the Stamping Department, was not guarded, January 8, 1986. b) The foot pedal on the model 6508 Wysong mechanical press brake, serial number P1311-108, (being used in punching operations), located near the west wall, was not guarded, January 8, 1986. c) The foot pedal on the model 10121 Niagara mechanical press brake (serial number L19109) located in the northwest corner of the plant was not guarded, January 13, 1986. d) The foot pedal on the Wysong squaring shear, model 1048, serial number P21-154, located near the west wall, was not guarded, January 8, 1986. e) The two foot pedals on the Niagara catalog J6 squaring shear, factory number 41203, located in the Fabrication Department, were not guarded January 8, 1986.
