OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a. On or about October 1, 2012, in the rail yard, the 20,000-lb rail car shaker hoist had several issues wrong with it, exposing employees to being struck by suspended loads. The following defects were noted; no periodic or frequent inspection Hook had safety latch removed Rigging had the clamps installed backward and were not forged steel The capacity was not clearly marked on the hoist or hoist tower Wire rope used for the lift wire was not attached with a thimble Electrical junction box 8-foot up the superstructure had the wires chaffing out of the box Tension cable disconnected on electrical leads to junction box No safety shackle between shaker unit and hoist Lift wires dry and rusting Among other methods, one feasible and acceptable abatement methods to correct this hazard is to have the capacity on the hoist in accordance with ANSI B.30-2007 and have the hoist inspected within the prescribed periodicity of the ANSI B30.16- 2007 ANSI B30.16-1973 16-2 Electric or air powered hoists, Section 16-2.1 Marking, construction, and installation, 16-2.1.1 Markings, 16-2.1.1.1 Rating; The rated load capacity shall be permanently marked on the hoist or load block and clearly legible from the operating position. ANSI B30.16-2007 16-2.2 Inspection, Testing, and Maintenance, 16-2.2.1 Inspection, 2. Periodic Inspection - One to twelve month intervals, or as specified by the manufacturer.
