29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). Jobsite: The employer did not ensure through providing appropriate training and performing an evaluaton that the forklift truck operator of the Allis Chalmers powered industrial truck (PIT) was competent to operate the PIT safely at all times. On or about July 23, 2012, the PIT tipped over and landed on the operator while the operator was trying to maneuver the PIT in and around inclined surface. The operator sustained very serious injuries and then succumbed from the iinjuries.
