Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards from fuel trucks during loading and fuel delivery. Employees were exposed to struck-by/crushing hazards from rolling fuel delivery vehicles while performing fuel delivery operations where the vehicle's wheels were not chocked and the brake had not been set. On May 25, 2012, at the Quincy MBTA Commuter Boat Terminal, an employee in the process of delivering fuel suffered fatal injuries when the fuel delivery truck unexpectedly rolled back and caught the employee in between the vehicle and a fence gate.
