North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees that were exposed to a struck-by/caught-in or between falling object due to employees working underneath a suspended load: a)facility - three production lines, employees were allowed to walk/work under a hopper containing dough, weighing approximately 175 pounds, that was suspended from a Budgit hoist. Among other methods, feasible methods that could be used to abate these hazards include prohibit raising the hopper and dough during the 10 minute rest cycle and to prohibit employees from walking or working underneath the hopper while filling the doughnut extruder.
