Nevada Revised Statute 618.375(1): Duties of employers. Every employer shall furnish employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his or her employees. Graham Packaging Company, LP did not have a workplace that was free of recognized struck-by and crushing hazards due to unsecured and damaged storage racks. a. In the systems room, there were two unsecured pallet racks. One rack was 16 feet 9 inches long by 40 inches wide by 80 inches tall and the other rack was 8 feet long by 40 inches wide by 112 inches tall. The employees could sustain serious injuries from being struck by or caught under the pallet rack or the materials stored on the rack if it were to tip over or collapse. Section 1.4.7 "All rack columns shall be anchored to the floor with anchor bolts capable of resisting the forces caused by the horizontal and vertical loads on the rack." Section 1.4.9 "Upon any visible damage, the pertinent portions of the rack shall be unloaded immediately by the user until the damaged portion is repaired or replaced." One feasible and acceptable means of abatement is to secure and repair or replace the damaged parts of the racks in accordance with ANSI MH16.1 - (2008).
