North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: a)At Station 8 - where an employee was operating a roll over protection (ROP) equipped "Hytsu", model #PG15T S100, gasoline type forklift and was observed not wearing the factory installed seatbelt. Abatement Note: One feasible means of abatement would be to retrain the operator on the safe operations of industrial forklifts, as well as enforcing a disciplinary policy that requires the use of a seatbelt while operating a forklift.
