NYSLL Article 2, Section 27-a.3.a(1): The employer did not furnish to each of its employees, employment and a place of employment which was free from recognized hazards that are causing or were likely to cause death or serious physical harm to its employees and which will provide reasonable and adequate protection to the lives, safety or health of its employees. In applying this paragraph, fundamental distinctions between private and public employment have been recognized. Location: Onondaga County Sheriff's Office Various Criminal Investigation Division (CID) emergency response vehicles were observed with holes in the front and rear floorboards, exposing officers to potential cuts and lacerations from jagged rusted metal, potential exposure to vehicle exhaust gases, and potential exposure to struck by hazards from roadway debris penetrating the passenger compartment. Some vehicles had holes above a catalytic converter, exposing officers to fire hazards resulting from carpeting or rubber contacting the catalytic converter. (Example of two random vehicles examined by the inspector: #3961 and #3975) Among other methods, some reasonable and adequate methods to correct this hazard include but are not limited to: examining all emergency response vehicles to identify condition of uni-body or frame; adequately repairing damaged floorboards; removing vehicles from service; or replacing vehicles. NOTE: Some vehicles had sheet metal from former street signs placed over the holes in the front driver side floorboard. This repair is not considered adequate since it does not prevent vehicle exhaust gas from entering the passenger compartment and does not provide a substantial restoration of the compromised floorboard.
