North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: caught in between hazards when the operator of a Toyota model 8FGU25 forklift was operating a the equipment while not wearing a seatbelt. a)facility, west paved lot, pallet staging - an employee operating a Toyota model 8FGU25 forklift, serial number 19305, was not wearing a seatbelt. ABATEMENT NOTE: 1)Among other methods, one feasible and acceptable abatement method to correct this hazard is to enforce existing forklift policies regarding operator protection devices such as seatbelts. Reference:Hazards recognized and addressed in the consensus Safety Standard for Low Lift and High Lift Trucks, ASME B56.1-1993. 5.3.19 and 5.3.18 (b)(5)
