Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard: a)Battery Area - A battery handling beam was not marked with its rated capacity and it was not being inspected, on or about March 7, 2012. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that the beam is marked with its rated capacity and is inspected in accordance with ASME B30.20-2010, sections 20-1.2.1 and 1.3.
