North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught in between hazards: a)job site - an employee who was operating a JLG Extendable Boom Forklift, model 1044C-54 Series II, was outside the cab of the machine working on the roof while the forks were raised. ABATEMENT NOTE: 1)Among other methods, one feasible and acceptable abatement method to correct these hazards is to fully lower the load-engaging means (forks) fully to the ground before exiting the operator's position.
