North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to permanent damage to the eye: a)mixing area-bowl of an eyewash fountain contained a box cutter with the blade exposed ( para 7.1.2, ANSI Z358.1-1990). b) mixing area-eyewash fountain in an area where chemicals such as ammonia are mixed, was not maintained in a sanitary condition or inspected or flushed on a required basis (para 5.5.1, ANSI Z358.1-1990).
