Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that employees were exposed to struck-by/crushed-by hazards: (a)On or about 01/19/12 - Machine Shop, employees were operating a forklift (1999 Linde H25D) where the restraint system had been removed when a new seat was installed. Among other methods, one feasible and acceptable method to correct this hazard would be to install a seat belt on the older model forklifts or purchase newer model powered industrial trucks equipped with seat belts and require operators to use the restraint system in accordance with ASME B.56.1-2000 "Safety Standard For Low and High Lift Trucks", Section 7.41 - Operator Restraint Systems.
