Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to dust explosion, deflagration, or other fire hazards from an ignition of combustible dust from static discharge: a) Top and Bottom Sheds - The employer did not ensure that grounding and/or bonding was maintained on the dust collector, equipment and duct work to dissipate static electricity. Employees were exposed to fire/explosion hazards while performing various assigned duties involving the manufacture of wood pallets and other saw mill operations. Samples taken on November 02, 2011 were determined to be a CLASS II combustible dust. Among other methods, one feasible and acceptable method to correct the hazard is to ground and/or bond the dust collector, ductwork and equipment as required by NFPA 664, "Standard for the Prevention of Fires and Explosions in the Wood Processing and Wood Working Facilities." 2007 Edition: Chapter 7, Section 7.9.2.(1).
