North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck-by vehicular traffic without an established work zone: a)Jobsite, vicinity of 505 Riceville Road, Asheville, NC - Flaggers and employees were exposed to vehicular traffic during tree work without having an established a work zone in accordance with the US Department of Transportation Manual on Uniform Traffic Control Devices (MUTCD) or applicable state and local laws and regulations. Reference ANSI Z133.1-2006. General Safety Requirements, 3.2 Traffic Control Around the Jobsite Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard would be to establish a work zone prior to beginning work according to the directives established in Parts V and VI of the MUTCD.
