Section 5(a)1 of the OSH Act: The employer failed to furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees in that employees were exposed to the hazard of being struck-by moving components of the Automatic Storage and Retrieval System (ASRS): a) in that employees were exposed to being struck-by the storage retrieval machines and the satellites while working in and around the equipment due to lack of training. The employer failed to ensure that new ASRS operators and mechanics understood the hazards to which they may be exposed while operating the equipment and how to prevent harm to themselves and others. Among other methods, one feasible and acceptable method of abatement includes, but may not be limited to: Establishing and implementing a structured and systematic training program, comparable to the one provided by the manufacturer of the ASRS, to prevent: 1. Untrained personnel from accessing the storage retrieval machine operating aisle during cleaning operations; 2. Personnel climbing through shelving making the safety features ineffective; 3. Presence of employees in the danger zone before setting the storage retrieval machines in automatic operating mode; 4. The storage retrieval machines operate in automatic while other employees were in the danger zone; and, 5. Personnel without knowledge of applicable workplace safety regulations evaluate the storage retrieval machine condition in relation to safety.
