North Carolina General Statute 95-129(01) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck or crushed by hazard: a)facility, throughout - where an employee operated a Hyster Electric Forklift (S#CL00W21532R, 3725lb capacity) equipped with a roll over protection system (ROPS) without a seatbelt. (Reference: American Society of Mechanical Engineers, Safety Standard for Low Lift and High Lift Trucks (forklifts), ASME B56-1-1993, paragraph 5.3.19) ABATEMENT NOTE: Retrain and document retraining for all forklift operators highlighting the importance of wearing seatbelts when operating the forklift.
