North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a)Facility - The "Caterpillar" model #P5000, S/N AT3503916, LP type forklift did not have a functioning back-up alarm and was being used to transport bundles of lumber from the saw department to the production lines. Abatement Note: One feasible means of abatement would be to install a working back-up alarm. Also, ensure that the alarms function is checked as part of the pre-shift inspection of the lift. The employer also could train employees to use the horn when operating the forklift in reverse.
