North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being crushed and/or struck by mechanized equipment. a) Sweet potato warehouse packing and storing operation, located at 2775 Hockaday Road, Four Oaks NC- Powered industrial trucks operators had been operating mechanized equipment without the benefit of adequate training. Employees had received formal training, where they were shown a forklift video, but were not given practical training or evaluated in their performance. In addition, two employees were operating a Yale model # MPW060LEN24T2780 walkie powered pallet truck without the benefit of training. Abatement Notice: One feasible and acceptable means of abatements is to develop and implement a training program that follows the requirements of the operation manual for each powered industrial truck to which employees will be assigned to operate. The training should be a combination of formal instruction, practical training, and evaluation in the performance of the equipment.e
