Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard: a)Staging Yard - on or about January 11, 2012 - no safety chains that are required by the manufacturer of the hopper were installed or used to secure this to the material handing lift. Among other methods of abatement, one feasible and acceptable means of abatement would be to follow the manufacturers operation instructions; "Secure the dumper to the fork truck's fork carriage with the attached safety restraint". Pursuant to 29 CFR 1903.19(c), the employer must provide certification to OSHA that this violation has been abated within 10 calendar day of the "Date By Which Violation Must be Abated".
