Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a struck-by hazard and an impalement hazard from the unprotected open cab. On or about Wednesday March 21, 2012 on site at 2156 Athens Highway Gainesville, GA 30507; a). The employees operating the Bobcat S220 Skid Steer Loader while grabbing, transporting and dumping large amounts of metal material and placing it into an into pile was not provided protection from material entering the front of the cab opening. Among other methods, one feasible and acceptable means of abatement include, but not limited, to: The employer shall ensure the special application kit is installed on the equipment when working in areas that may cause flying debris or objects to enter the front of the cab.
