Text For Citation: 01 Item/Group: 001 Hazard: DUST&FUMES
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to stuck-by hazards: a)facility - the Caterpillar V150 forklift truck, serial #92W03137, used on uneven muddy terrain to raise the saw dust trailer for cribbing, was not equipped with a functioning seat belt. A feasible and acceptable method of abatement is to follow the forklift truck manufacturer's recommendation that states, "Seat belts must be worn when seated in the seat".
