Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that a Kubota tractor root rake/grapple attachment was being used as a elevated platform: a). West of 5725 West IRLO Bronson Memorial Hwy where trees were being trimmed, truck operations were not enforced when an employee was allowed to stand on a elevated Kubota tractor root rake/grapple attachment exposing him to a 6 ft fall hazard. This violation was observed on or about 05/09/11. Among other methods, an acceptable method to correct this hazard is: when a forklift is used to elevate employees, a work platform equipped with standard guardrails firmly secured to the lifting carriage or forks shall be used.
