Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from skid steers being operated by untrained operators: a)Throughout the facility: On July 13, 2011 and at times prior to, the employer failed to train all employees in accordance with the Bobcat Operation & Maintenance Manual, A300 All Wheel Steer in that employees were not trained or their performance evaluated by the company to ensure the safe operation of the equipment. Among other methods, one feasible and acceptable means of abatement would be to ensure that each operator has completed operator training and evaluation in accordance with the Operation and Maintenance Manual, A300 All Wheel Steer.
