Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: At Project AC-018345 site, demolition and construction of bridge at Road PR 183 Km 19.8 - concrete bucket Manufacturer Gar-Bro, model 420-R, was lifted supported by an alloy steel chain sling PA-10 that was knotted (two extremes tied) in two different places. On 10-13-2011, the steel chain got loose and the bucket full of concrete fell impacting an employee that suffered fractures and a puncture injury. The employee died on 11-02-2011 from complications due to the accident. Employer did not comply with rigging practices as specified by OSHA and chain slings manufacturers which indicates that chain slings should not be used with knots. Hazard: Impact employee from fall of load due to failure of chains to have the capacity to support load. Among other methods, a feasible and acceptable abatement method to correct this hazard is: 1.Use attachments, such as hooks, rings, oblong links, pear shaped links, or mechanical coupling links and assure that they have a rated capacity at least equal to that of the alloy steel chain which are used. 2.Adquire slings that are specified by manufacturer to show size, grade and rated load. 3.Designate a qualified person to inspect slings and all fastenings and attachments each day before use for damage or defects. 4.Make periodic inspections of alloy steel chains slings at intervals no greated than 12 months. 5.Use the alloy steel slings with loads as rated capacities in accordance with the manufacturer's recommendations and specifications described in Table H-1: Rated capacity (working load limit), for alloy steel chain slings of regulation OSH 1926.251. En el sitio del Proyecto AC-018345, demolicion y construccion del puente en la Carr.PR 183 Km 19.8 - el "bucket" de transportar concreto de Manufacturero Gar-Bro, modelo 420-R, fue levantado y sostenido por una eslinga de cadena en acero aleado PA-10 que tenia nudos (dos extremos amarrados) en dos lugares diferentes. El dia 10-13-2011, la cadena en acero aleado se solto y el "bucket" lleno de hormigon cayo e impacto a empleado que sufrio fracturas y lesion punzante. El empleado murio el dia 11-02-2011 por complicaciones asociadas al accidente. El patrono no cumplio con las practicas de aparejo como especificiadas por OSHA ymanufactureros de eslinga de cadenas de aleacion en acero que indican que las cadenas de eslinga no deben ser usadas con nudos. Riesgo: Impactar empleado por caida de carga debido a falla de cadenas tener la capacidad de sostener la carga. Entre otros metodos, un metodo factible y aceptable de corregir este riesgo es: 1.Usar aditamentos, tales como ganchos, anillos, acoplamientos oblongados, acoplamientos en forma de pera, o acopladores mecanicos y asegurar que estos tienen capacidad de carga clasificada por lo menos igual a la de las cadenas en acero aleado que son usadas. 2.Adquirir eslingas que son especificadas por el manufacturero que muestren el tamano, grado y capacidad de carga. 3.Designar persona cualificada para inspeccion de las eslingas y todos los conectores y aditamentos a diario antes de su uso para dano o defectos. 4.Realizar inspecciones periodicas de las eslingas de cadenas en acero a intervalos no mayor de 12 meses. 5.Utilizar las eslingas en acero aleado con cargas segun la capacidad de carga de acuerdo a las recomendaciones del manufacturero y las especificaciones descritas en la Tabla H-1: "Rated capacity (working load limit), for alloy steel chain slings" del reglaemento OSH 1926.251.to
