Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall of 20 feet: a) 331 E. 29th St Ground floor elevator: On or about May 18, 2011 An employee fell approximately 20 feet down an elevator shaft while repairing the call buttons. Among other methods, one feasible and acceptable method to correct this hazard is: Comply with "Elevator Industry Field Employee's Safety Handbook" 2010 standards, stipulated by the National Elevator Industry Inc Safety Committee and published by Elevator World Inc, Section 4 "Fall Protection - General Requirements" which states that, "Fall protection is required when a worker is exposed to a fall hazard (working more than 6ft(1.8m) above a lower level and an opening more than 12in.(305mm). There are three ways of controlling fall hazards. Elimination of the fall hazard should be the first consideration. The second consideration is a guardrail system, and the third is a personal fall arrest system." NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.0
