Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard while installing sheet metal siding from a step ladder positioned beneath an elevated load placed on a rough terrain forklift. Among other methods, one feasible and acceptable method to correct this hazard is to ensure that employees are not allowed to stand or pass under the elevated portion of any rough terrain forklift, whether empty or loaded in accordance with ASME B56.6-1992 Para 6.2.7.: SAFETY STANDARDS FOR ROUGH TERRAIN FORKLIFT TRUCKS.
