Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to struck-by hazards: On or about June 4, 2011, and times prior thereto, employees working at the Marina Village Mobile Home Park and other remote job sites were exposed to struck-by hazards when loading a Kubota L39TL backhoe on a trailer in that: a.The employer did not maintain a safe zone around the trailer. b.The employer did not ensure the trailer deck was free from holes, missing and/or rotted wooden planks. c.The employer did not ensure the trailer selected for transport was capable of carrying the weight of the backhoe. Among other methods, one feasible and acceptable method to correct this hazard is to ensure all equipment operators and supervisors prevent personnel from entering the danger zone around the trailer during the loading and unloading of the equipment, ensure the trailer deck is free from floor holes which could tip the load and ensure the trailer is rated for the weight of the equipment to be transported.
