Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing injuries and struck by hazards from a falling load or hoist parts while using electric powered chain hoists: a.On or about October 5, 2011, at Section #1(Welding Area) and Section #2(Exterior walls build-in) in the manufacturing area, the rated load capacity of the lifting devices had not been marked on the hoists or the trolley to be legible from the ground. b.On or about October 5, 2011, through out the manufacturing area, the lifting devices had not been inspected periodically or proof tested and certified by the employer to ensure that critical components of the electric powered hoists, including but not limited to, the hoist machinery, chains and hooks did not malfunction while in operation. Among other methods of feasible and acceptable means to abate this hazard are, such as but not limited to: 1.The employer shall mark the rated load capacities on the hoist or the trolley in such a way that can be visible from the ground in accordance with the ANSI/ASME B.30.16, "Safety Standard for Overhead Hoists" by the American National Standards Institute. 2.The employer shall establish inspection and testing procedures for the hoisting devices, including but not limited to, the hoist machinery, pendant controls, chains, hooks and other lifting devices to detect if operating conditions can constitute a safety hazard due to, among other items, deterioration, excessive wear and distorted parts in accordance with the ANSI/ASME B.30.16, "Safety Standard for Overhead Hoists" by the American National Standards Institute. The employer's Operating and Maintenance Instruction manual for the Coffing electric powered hoists provided an Inspection and Maintenance Checklist and also an Inspection Report form for reference. ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED.
