Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fire and explosive hazard: a.On or about August 19, 2011, in the aboveground fuel storage tank area, the employer failed to provide an accessible means to delivery drivers to determine the level of flammable liquid in the tanks, exposing employees to fire and explosive hazards. ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED. Among other methods, recognized and feasible means of abatement to correct the hazard include but not limited to: using calibrated mechanical, digital, electrical tank level indicators or by keeping and verifying accurate records for tank disbursement and requiring delivery drivers to verify tank levels prior to filling aboveground storage tanks: Ref NFPA 30-15, 2-3.4.1(d)
